Terms of Use

1. General
These Terms of Use govern the contractual relationship between commitery.com and users of the platform commitery.com. By registering, users accept these terms.
By using or accessing our services, you agree to these Terms of Use and, where applicable, any product-specific terms, acceptable use policies, and data processing provisions (collectively, the “Agreement”).
If you do not agree with the provisions of this Agreement, you are not permitted to use or access our services.
2. Creating an Account
2.1 Registration
To use many of our services, you must first create a user account. You agree to provide truthful, complete, and up-to-date information during registration and use. We reserve the right to use this information to contact you if needed.
2.2 Security of Your Credentials
Please keep your login credentials (especially passwords) confidential and protect your account from third-party access. You are solely responsible for all activities that occur under your account and for safeguarding your passwords. We are not liable for any loss or damage resulting from unauthorized use of your account. If you suspect misuse, loss, or theft of your credentials, you must notify us immediately.
2.3 Minimum Age
Our services are intended exclusively for individuals aged 18 and over. By using the services, you confirm that you are at least 18 years old. If you are under 18, you are not permitted to use our services.
2.4 Account Inactivity, Unconfirmed Accounts, and Deletion
We reserve the right to suspend or delete user accounts that remain inactive for a prolonged period, subject to the conditions set out below.
Unconfirmed accounts: If a user creates an account but does not confirm their email address and no goal, commitment, or financial transaction has been created, we may delete the account 30 calendar days after registration without further notice. Such accounts are considered incomplete and non-operational.
Inactive accounts without active goals: If an account has a confirmed email address but no active goals, commitments, or ongoing contractual obligations, and the user has not logged in or otherwise used the services for a period of 24 consecutive months, we may delete the account. Where required by applicable law, we will make reasonable efforts to notify the user in advance using the email address associated with the account.
Accounts with active or past commitments: Accounts that contain active goals, unresolved commitments, financial transactions, or other contractual or legal obligations will not be deleted solely due to inactivity. Data related to such accounts will be retained for as long as necessary to fulfill contractual obligations and to comply with statutory retention requirements under applicable law.
Effect of deletion: Deletion of an account does not affect rights or obligations that arose prior to deletion, including completed transactions, outstanding payments, claims, or mandatory legal retention periods. Data that we are legally required to retain will be stored in a restricted manner and deleted once the applicable retention period expires.
2.5 Account Deletion by the User
The user may request deletion of their account at any time via the account settings or by contacting support at support@commitery.com.
Account deletion is only possible if (i) there is no active commitment, (ii) no pending proof review or dispute process is ongoing, and (iii) no conditional charge is due or being processed. If an account deletion request is made while commitments are active or contractual obligations remain, Commitery may postpone deletion until such commitments have been completed, cancelled, or otherwise resolved.
Deletion of an account does not affect rights or obligations that arose prior to deletion, including completed transactions, charges initiated due to a negative verdict, refunds processed after disputes, or statutory record-keeping obligations. Data that Commitery is legally required to retain (e.g., records relevant to accounting, taxation, or fraud prevention) will be retained in a restricted manner for the applicable statutory retention period and deleted thereafter.
2.6 Third-Party Login Providers (e.g. Google)
In addition to registering with an email address and password, users may be given the option to authenticate using third-party login providers, such as Google (“Third-Party Login Providers”).
When a user chooses to sign in via a Third-Party Login Provider, authentication is carried out directly by that provider in accordance with its own terms and privacy policies. Commitery does not receive or store the user’s password or other authentication credentials used with the Third-Party Login Provider.
Depending on the selected provider and the permissions granted by the user, Commitery may receive limited account information from the provider, such as:
the user’s email address,
a unique provider-specific user identifier,
the user’s display name, and
a profile image (if provided and enabled by the user).
This information is used exclusively for the purpose of creating and managing the user account, enabling secure login, and preventing misuse or fraud. No additional data is accessed beyond the information explicitly authorized by the user during the authentication process.
By using a Third-Party Login Provider, the user acknowledges that the use of such provider is subject to the provider’s own terms and conditions and privacy policies, which apply in addition to these Terms of Use. Commitery is not responsible for the availability, functionality, or conduct of Third-Party Login Providers.
Commitery reserves the right to enable, modify, or discontinue the availability of specific Third-Party Login Providers at any time.
For authentication via Google, the Google Terms of Service and the Google Privacy Policy apply.
3. Content
As part of the services offered by Commitery, users may create commitments. A commitment consists of (i) a clearly defined personal goal, (ii) a goal deadline by which the goal must be completed, and (iii) a proof submission deadline by which suitable evidence of goal completion must be submitted.
To support adherence, users are required to pledge a monetary commitment as a commitment device. This amount will not be charged at checkout, the amount is only due if the goal is deemed not completed after a negative verdict.
Goal completion is determined based on the submission of proof. Proof refers to the evidence submitted by the user to demonstrate that the goal has been fulfilled in accordance with the predefined requirements. Commitery defines the specifications and requirements for acceptable proof for each goal; these specifications are binding and constitute the sole basis for evaluating goal completion.
A verdict on whether a goal is considered completed or not completed is issued after review of the submitted proof. Such review may be conducted by one of the following referee types: (i) an AI-based referee provided by Commitery, (ii) a human referee provided by Commitery, or (iii) an external referee designated by the user.
3.1 Goal Definition
The user must define a personal goal that serves as the basis for the commitment and for the subsequent evaluation of goal completion. Goal definition is an essential element of the service and is subject to the following requirements:
- Personal nature and control: The goal must be personal, meaning that its achievement depends predominantly on the user’s own actions, decisions, and behavior. Goals whose outcome depends primarily on chance, external events, or the actions of third parties are not permitted. The service must not be used to place bets, wagers, or predictions on external outcomes.
- Clarity and specificity: The goal must be formulated in a clear, concrete, and unambiguous manner. Vague or aspirational statements (e.g., “I want to get fitter”) are insufficient. A precise and verifiable formulation is required (e.g., “My goal is to run a marathon”).
- Measurability: The goal must be defined in objectively measurable terms, including, where applicable, quantities, frequencies, factual criteria, or time-bound parameters (e.g., “Lose 5 kg by June 1” or “Meditate daily for 30 consecutive days”).
- Realism and appropriateness: The goal must be realistic, reasonable, and appropriate. Goals that are manifestly unrealistic, unlawful, unsafe, or harmful to health may be rejected at the provider’s discretion.
- Exclusions: Goals may not have the character of a wager or speculative activity. Defining goals on behalf of third parties, or goals whose fulfillment cannot be meaningfully influenced by the user, is not permitted.
- Changes and adjustments: Once checkout has been completed, changes to the goal definition are generally excluded. In exceptional cases or in the event of technical issues, users may contact support at support@commitery.com; however, there is no entitlement to subsequent modification.
3.2 Deadlines
For each commitment, the user must define (i) a goal completion deadline by which the goal must be fully achieved and (ii) a proof submission deadline by which suitable evidence of goal completion must be uploaded. Both deadlines are binding and form an essential part of the commitment.
The goal completion deadline specifies the latest point in time at which the substantive requirements of the goal must be fulfilled. The proof submission deadline specifies the latest point in time at which all required evidence must be submitted in full and in the prescribed format.
Unless explicitly stated otherwise, all deadlines are calculated based on the time zone displayed in the user interface at the time of goal creation. The user is solely responsible for selecting appropriate deadlines and ensuring timely completion and submission.
The maximum duration between goal creation and the goal completion deadline is 730 calendar days. The proof submission deadline must fall within 1 to 30 calendar days after the goal completion deadline.
Evidence submitted after the proof submission deadline, or evidence that is incomplete, unreadable, or does not meet the predefined proof specifications, will not be considered. In such cases, the goal shall be deemed not completed.
Extensions, pauses, or retroactive changes to deadlines are generally excluded. Technical issues on the user’s side, including but not limited to connectivity issues, device failures, or late uploads, do not constitute grounds for deadline extensions.
If no valid proof is submitted by the proof submission deadline, or if the submitted proof does not meet the applicable requirements, the commitment is conclusively evaluated as not fulfilled, and the corresponding consequences apply in accordance with these Terms.
3.3 Monetary Commitment Amount
For each commitment, the user must pledge a monetary amount (“Commitment Amount”) as a self-imposed commitment device; the Commitment Amount represents the financial consequence associated with the outcome of the goal and constitutes an essential element of the commitment. The minimum Commitment Amount per goal is €1.00; where applicable, maximum amounts or additional limits may be displayed in the user interface at the time of goal creation, and the user freely determines the Commitment Amount within the applicable limits prior to checkout.
The Commitment Amount is not charged at the time of goal creation and instead constitutes a conditional payment obligation that becomes due only if the goal is deemed not completed in accordance with these Terms and the applicable proof requirements. If the goal is deemed completed, no charge of the Commitment Amount will be made.
If the goal is deemed not completed, including but not limited to cases where no valid proof is submitted on time or the submitted proof does not meet the required specifications, the Commitment Amount will be charged in full in the amount specified at checkout, together with any non-refundable fees disclosed prior to payment, and the user expressly authorizes Commitery to initiate such charge via the payment method selected at checkout.
Payments and charges are processed via Stripe, Inc.; the Stripe Services Agreement and Privacy Policy apply.
3.4 Proof Specifications and Evidence Requirements
For each commitment, Commitery defines and provides a binding proof specification that determines what constitutes acceptable evidence for successful goal completion (“Proof Specifications”). The Proof Specifications are generated by Commitery based on the individual goal definition and are presented to the user prior to checkout as part of the goal overview.
The Proof Specifications may be generated using automated language models operated by Commitery, including large language models provided by third-party service providers such as OpenAI, L.L.C. In this context, goal-related information may be processed solely for the purpose of generating appropriate Proof Specifications. Such data is processed in accordance with applicable data protection laws and is not used by the AI service provider to train or improve its models. Processing by OpenAI is subject to the OpenAI Privacy Policy.
The Proof Specifications exclusively govern the type, scope, format, and content of evidence that may be submitted and may include, without limitation, requirements regarding (i) the form of evidence (e.g. photographs, screenshots, documents, files), (ii) content and clarity, (iii) time reference or timestamps, (iv) completeness, and (v) verifiability. Only evidence that complies fully with the applicable Proof Specifications shall be considered valid.
The user acknowledges and agrees that the Proof Specifications are binding, constitute the sole benchmark for evaluating goal completion, and form an integral part of the contractual commitment. Subjective interpretations, alternative evidence, or supplementary explanations that fall outside the Proof Specifications shall not be considered.
Proof must be submitted within the deadline defined for the respective goal. Evidence submitted after the applicable deadline or in a form that does not meet the Proof Specifications shall be deemed invalid, and the goal shall be considered not completed.
3.5 Evidence Review and Referee System
After the applicable goal period has ended, the user must submit proof in accordance with the applicable Proof Specifications and within the defined submission deadline. The determination of whether a goal is deemed completed or not completed (“Verdict”) is made through one of the referee mechanisms described below.
The user acknowledges that the Verdict is based solely on the submitted proof and the applicable Proof Specifications and is independent of the user’s subjective intent or effort.
The following referee types are available:
(i) AI-based referee: Commitery may use an automated evaluation system based on an artificial intelligence model operated on the platform to assess whether the submitted proof meets the applicable Proof Specifications. The AI-based referee performs a structured, criteria-based assessment and issues a Verdict accordingly. For this purpose, submitted proof data may be processed by third-party AI service providers, including OpenAI, L.L.C., acting as a data processor on behalf of Commitery. Proof data is transmitted solely for the purpose of automated evaluation, is processed in accordance with applicable data protection laws, and is not used by the AI provider to train or improve its models. Processing by OpenAI is subject to the OpenAI Privacy Policy, and Commitery ensures that appropriate contractual safeguards are in place to protect user data.
(ii) Internal referee (Commitery): Commitery may assign an internal employee to manually review the submitted proof and determine whether it meets the applicable Proof Specifications. The internal referee acts on behalf of Commitery and issues a binding Verdict.
(iii) External human referee (A Friend): The user may designate an independent third person (e.g. a friend or acquaintance) as an external referee at the time of goal creation. The designated referee will receive a notification email after Checkout. After the proof submission deadline expires the external referee will receive another email granting access to the submitted proof and requesting a decision on whether the proof satisfies the applicable Proof Specifications. The external referee must issue a decision within a timeframe of 14 days. Commitery is not responsible for the conduct, availability, or decision-making of external referees and does not guarantee the timeliness or accuracy of their verdicts.
If an external referee fails to issue a decision within the specified timeframe, Commitery reserves the right to assign an alternative referee, including an AI-based or internal referee, to ensure timely resolution. The Verdict issued by the applicable referee is binding for the purpose of determining goal completion and the resulting financial consequences under these Terms.
3.6 Checkout
Before setting the goal and confirming the user’s payment details, the user receives an overview of all relevant configurations, including the defined goal, applicable deadlines, proof specifications, and selected referee type. The user must confirm via checkbox that they have read, understood, and accepted the Terms of Use, the binding Proof Specifications, the applicable age restrictions, and the right of withdrawal, where applicable.
At checkout, no charge of the Commitment Amount is made. Commitery processes payment authorization and any subsequent charges exclusively via Stripe, Inc.. By completing checkout, the user authorizes Commitery to initiate a charge via the selected payment method only if the goal is later deemed not completed in accordance with these Terms. Payment processing is subject to the Stripe Services Agreement and the Stripe Privacy Policy.
4. Right of Withdrawal
4.1 Statutory Right of Withdrawal
Consumers have the right to withdraw from this contract within 14 days without stating any reason. The withdrawal period begins on the date on which the contract is concluded. To exercise the right of withdrawal, the user must notify Commitery of their decision to withdraw by means of a clear statement (e.g. by email).
If the user withdraws from the contract before the expiration of the withdrawal period, the commitment is cancelled and no Commitment Amount will be charged. Where no charge has been initiated at the time of withdrawal, no payment is due.
The right of withdrawal expires prematurely if the user expressly agrees to the commencement of performance before the end of the withdrawal period and acknowledges that the right of withdrawal is forfeited once the commitment has been fully activated and the service has begun, including but not limited to cases where the goal period has started.
The exercise of the right of withdrawal does not affect any statutory rights or obligations that arose prior to withdrawal. This consent and acknowledgment are obtained via an explicit checkbox during checkout.
4.2 Dispute of Negative Verdicts
If a goal is deemed not completed and a corresponding charge of the Commitment Amount has been initiated, the user may submit a dispute within the timeframe specified by Commitery. A dispute must be based on the claim that the submitted proof was incorrectly evaluated against the applicable Proof Specifications.
Upon submission of a dispute, Commitery may conduct a secondary review using an automated evaluation system based on an artificial intelligence model, which reassesses the disputed proof exclusively against the originally applicable Proof Specifications and the information provided by the user. Commitery does not disclose the internal logic, weighting, or methodology used in such automated dispute reviews.
For the purpose of dispute review, proof data and dispute-related information may be processed by third-party AI service providers, including OpenAI, L.L.C., acting as a data processor on behalf of Commitery. Such data is processed solely for the purpose of dispute resolution, is not used to train or improve AI models, and is handled in accordance with applicable data protection laws. Processing by OpenAI is subject to the OpenAI Privacy Policy.
If the dispute review determines that the original negative verdict was incorrect, Commitery will reverse the verdict and initiate a refund of the entire Amount that was charged in error.
5. Disclaimer
5.1 No Professional Advice
Commitery provides organizational and motivational support for goal pursuit. It does not constitute medical, psychological, therapeutic, or legal advice. Users are responsible for setting only appropriate goals; in case of doubt, consult a physician or other qualified professional in advance.
5.2 Limitation of Liability
No liability is assumed for damages resulting from failure to achieve goals, improper use of the platform, false statements by users, or insufficient evidence, nor for indirect/consequential damages or missed refunds, unless due to intentional misconduct or gross negligence. Availability or functionality may be impaired (e.g., Stripe outages, maintenance); no liability is assumed for such impairments.
5.3 Service Availability and Technical Failures
Commitery endeavors to ensure continuous availability of the platform; however, uninterrupted access cannot be guaranteed. Temporary unavailability may occur due to maintenance, technical failures, security incidents, force majeure events, or circumstances beyond Commitery’s reasonable control. If, due to a material technical failure attributable to Commitery, the platform is unavailable for a period that prevents the user from submitting required proof, receiving a verdict, or otherwise fulfilling a commitment in accordance with these Terms, the affected commitment shall be deemed void, and no Commitment Amount shall be charged in relation to that commitment. In such cases, any pending or conditional payment authorization related to the affected commitment will be canceled, and no adverse verdict shall be issued. Commitery shall not be liable for unavailability caused by external services, including but not limited to hosting providers, payment processors, email services, or internet connectivity issues outside Commitery’s direct control.

7. Final Provisions
7.1 Governing Law and Jurisdiction
If any provisions are wholly or partially invalid, the validity of the remaining provisions remains unaffected. The law of the Federal Republic of Germany applies (excluding the UN Convention on Contracts for the International Sale of Goods). Mandatory consumer protection provisions of the user’s country of residence remain unaffected. The place of jurisdiction—where legally permissible—is the provider’s registered office; consumers may alternatively bring an action before the court of their place of residence.
7.2 Governing Language
These Terms may be made available in multiple languages for convenience. In the event of any discrepancy, inconsistency, or conflict between language versions, the English version shall prevail.
7.3 Assignment and Transfer
Users may not assign, transfer, or otherwise dispose of any rights or obligations arising from these Terms without the prior written consent of Commitery. Commitery may assign or transfer its rights and obligations under these Terms to a third party in connection with a merger, acquisition, corporate restructuring, or transfer of business assets, provided that such transfer does not materially disadvantage the user.
7.4 Amendments to the Terms
Commitery may amend these Terms where reasonable and necessary to reflect changes in law, regulatory requirements, technical developments, or service offerings. Users will be informed in due time about material changes. Continued use of the services after the amended Terms enter into force constitutes acceptance of the updated Terms.
