Commitery Creator Terms

These Commitery Creator Terms govern the Commitery Creator program. They explain who may create referral links, when a referred commitment may be attributed to a participant, and when a payout may become payable.

These terms apply in addition to the Terms of Use, Payment Terms, Withdrawal Policy, Privacy Policy, and any in-product rules shown in the Creator dashboard.

1. Program Overview

Commitery Creator lets eligible users create referral links or proposed commitment links. If another user creates an eligible commitment through such a link and that commitment later receives a final failed verdict, the Creator may receive a share of the collected commitment amount if all payout conditions are satisfied.

The program is intended to support accountability and commitment discovery. It must not be used for betting, gambling, speculative outcomes, deceptive marketing, harassment, or any unlawful activity.

Commitery Creator is not insurance, goal insurance, an investment product, a prize pool, or a reward system for users who complete their own goals. It is a creator program under which an eligible Creator may receive a payout only under these terms.

2. Eligibility

To participate, you must have a Commitery account, be at least 18 years old, operate as an independent business established in Germany, comply with all Commitery terms, complete the Creator billing profile, and set up an eligible German payout account through Stripe Connect before creating upside-participating offers.

Commitery may refuse, suspend, restrict, or remove access to Commitery Creator at any time where required by law, Stripe requirements, risk controls, suspected abuse, or product limitations.

During the current launch phase, Commitery Creator is available only to businesses established in Germany. Commitery may expand eligibility later and may require renewed tax or payout verification before doing so.

3. Payout Account and Stripe Terms

Payouts are handled through Stripe Connect. To receive payouts, you must complete Stripe onboarding, keep your payout account in good standing, and provide accurate, complete, and current information requested by Stripe or Commitery.

Payment processing and payout services for Creators are provided by Stripe and are subject to the applicable Stripe Connected Account Agreement, Stripe Services Agreement, and Stripe policies. You authorize Commitery to share information with Stripe where necessary to provide payout services, prevent fraud, comply with law, and administer the program.

4. Referral Links

A referral link may be a general Commitery link or a proposed commitment link. A proposed commitment link contains a suggested commitment text that another user may choose to accept.

You are responsible for how you share your links. You must not use spam, misleading claims, impersonation, paid ads that violate platform rules, hidden tracking, forced clicks, unauthorized incentives, or any method that creates false, coerced, or low-quality referrals.

You must clearly disclose that you may receive an upside participation payout if someone creates a commitment through your link and that commitment fails.

5. Attribution

Visiting or opening a Creator link alone does not establish or replace account-level attribution. Attribution is established only when the referred user successfully completes checkout for an eligible commitment through a valid Creator or proposed commitment link.

After such checkout, the Creator may remain attributed to future commitments created by that account for up to twelve months. A later successful checkout through another eligible Creator replaces the account-level attribution prospectively. Merely visiting another Creator's page does not replace it.

Users may remove their active Creator attribution in account settings. Removal or replacement affects only future commitments. The Creator, referral link, payout percentage, and other payout terms recorded for a commitment already created remain fixed for that commitment and are not changed retroactively.

For proposed commitment links, attribution may require that the referred user accepts the proposed commitment without materially changing the proposed commitment text. Self-referrals, expired or inactive links, and other ineligible referrals do not establish attribution.

If multiple referral links, campaigns, devices, accounts, or tracking signals apply, Commitery decides attribution in its reasonable discretion based on the records available in its systems. Commitery may correct attribution errors and is not required to pay duplicate upside amounts for the same commitment.

6. When Creator Earnings May Become Payable

A payout may become payable only if all of the following are true:

  • The Creator was eligible when the link was created.
  • The commitment was validly attributed to the Creator.
  • The referred commitment or routine cycle was not withdrawn.
  • The commitment or routine cycle received a final failed verdict after any applicable product dispute window and timely product dispute.
  • The related commitment amount was successfully collected.
  • No refund, successful dispute, chargeback, reversal, fraud review, or policy violation prevents payout.
  • The Creator has an eligible Stripe payout account.

If any condition is not satisfied, no payout is owed. Commitery may delay payout while a withdrawal period, dispute period, payment-risk review, refund review, chargeback period, or Stripe verification remains open.

A failed verdict proposal, pending dispute, pending charge attempt, or pending Stripe balance does not make an upside payout finally payable. A payout becomes finally payable only after Commitery has collected the related amount and the applicable withdrawal, product dispute, refund, chargeback, fraud, and Stripe account checks no longer prevent payout.

7. Routines

If a referred commitment is part of a routine, attribution and payout eligibility may be assessed per routine cycle. A failed cycle may be eligible only for that cycle's collected amount. A withdrawn, cancelled, completed, refunded, or successfully disputed cycle is not eligible for an upside payout.

8. Payout Amount

The payout amount is calculated according to the percentage, fixed amount, campaign rule, or product rule shown by Commitery for the relevant referral offer at the time the commitment is created. If no payout amount is shown, no specific payout amount is guaranteed.

Payouts are calculated from amounts actually collected by Commitery for the failed commitment or routine cycle, after any refunds, reversals, taxes, payment-provider limitations, or corrections that apply. Referral payouts do not increase the amount owed by the referred user.

Commitery may transfer an eligible referral allocation to the Creator's Stripe Connect balance before it is released as a bank payout. Such transferred balances may remain pending or held under manual payout timing, risk controls, reserve periods, verification requirements, or other Stripe controls. Unless Commitery states otherwise in the product, each referral allocation is held for a risk period of at least 30 days before it becomes eligible for a bank payout.

Eligible allocations are normally grouped by Creator and currency into one monthly payout. An allocation that completes its risk period during a calendar month is normally included in the next monthly payout run. This means an allocation may remain in the Creator's Stripe balance for longer than 30 days. Commitery may run a payout later where required by risk controls, refunds, disputes, Stripe availability, incomplete billing information, or legal requirements.

The payout amount shown by Commitery is inclusive of any VAT or similar transaction tax that the Creator is required to account for, unless Commitery expressly states otherwise. The applicable tax treatment is based on the billing and tax information supplied by the Creator.

9. No Guaranteed Income

Commitery Creator does not guarantee income, recurring revenue, investment returns, employment, agency status, partnership, or any minimum payout. You participate as an independent user and are responsible for your own costs, taxes, registrations, and compliance obligations.

10. Taxes and Reporting

You are responsible for determining and paying any taxes, social security contributions, registrations, reporting obligations, or other obligations required in connection with payouts you receive. Commitery or Stripe may request tax information or withhold, report, or delay payouts where required by law or platform rules.

By completing the Creator billing profile and accepting these terms, you confirm that you provide Creator referral services independently as a business. You agree that Commitery may issue invoices in the form of self-billing documents (German: "Gutschrift") in your name for eligible Creator services. Commitery normally issues one structured ZUGFeRD/Factur-X Gutschrift for each monthly payout and sends it to the email address associated with your account. You must provide and maintain your correct legal name, German business address, tax treatment, tax number, and VAT identification number where applicable.

Commitery may validate a VAT identification number through the European Commission's VIES service and retain the validation result, request date, and returned business details as compliance evidence. A VAT-registered Creator must maintain a valid German VAT identification number. A Creator using the small-business rule must provide the tax number required for the Gutschrift.

You must review each Gutschrift and notify Commitery promptly if it is incorrect. You may object to a Gutschrift as permitted by applicable law. An objection does not entitle you to retain an overpayment or an amount that was invalid because of a refund, chargeback, fraud, error, or other grounds under these terms.

11. Prohibited Conduct

You must not:

  • Create self-referrals or refer accounts you control.
  • Create fake accounts, fake commitments, fake proof, or coordinated failed commitments.
  • Coordinate referrals, failed verdicts, product disputes, refunds, chargebacks, or payout timing to obtain or keep an upside payout.
  • Pressure, deceive, harass, or manipulate users into accepting commitments.
  • Represent that Commitery guarantees a particular result, payout, or outcome.
  • Use referral links for betting, gambling, contests of chance, illegal activity, or harmful commitments.
  • Market Commitery as insurance, goal insurance, a failure-protection product, an investment, or a prize-pool system.
  • Use spam, scraped contact lists, misleading ads, malware, hidden redirects, or unauthorized tracking.
  • Interfere with proof review, referee decisions, disputes, withdrawals, or payment processing.

12. Suspensions, Adjustments, and Clawbacks

Commitery may suspend links, archive links, withhold payouts, reverse pending payout balances, reverse Stripe transfers where available, offset future payouts, or request repayment if we believe a payout was caused by error, abuse, fraud, withdrawal, refund, chargeback, successful dispute, policy violation, or other invalid activity.

If your Stripe payout account becomes restricted, closed, or unable to receive transfers, Commitery may hold or cancel payouts until the issue is resolved. Commitery is not responsible for delays caused by Stripe, banks, payment networks, verification checks, or incorrect payout details.

If a related payment is refunded, charged back, reversed, or disputed successfully after an upside allocation has been transferred to your Stripe Connect balance, Commitery may attempt to reverse the transfer or otherwise recover the corresponding amount. If Stripe has already paid funds out to your bank account, you remain responsible for repaying any invalid, reversed, or overpaid amount.

13. Marketing and Brand Use

You may share your referral links and Commitery-provided assets for the purpose of referring users to Commitery. You must not alter Commitery branding in a misleading way, register domains or social handles that impersonate Commitery, or suggest that you are employed by or authorized to speak for Commitery unless we have given written permission.

14. Program Changes and Termination

Commitery may modify, pause, or terminate Commitery Creator, including payout percentages, eligibility rules, attribution rules, countries, supported payout methods, and campaign rules. Changes do not affect mandatory rights and will not reduce a payout that has already become finally payable unless the payout is invalid due to error, fraud, chargeback, refund, withdrawal, successful dispute, or legal/payment provider requirements.
