Referral Waiver Terms

These Terms govern the referral waiver: the option offered on a failed commitment to avoid its conditional charge by referring one new user to Commitery. They apply in addition to the Terms of Use, the Payment Terms, the Withdrawal Policy, and the Privacy Policy.

Sharing a referral waiver link is subject to section 5 of the Referral and Challenge Terms, which applies to every link issued in the product. Where these Terms and the Payment Terms cover the same subject, these Terms apply to the waiver and the Payment Terms continue to govern the underlying conditional charge.

The waiver is a voluntary feature. It is not a prize, a competition, a bonus scheme, a payout, or a form of insurance against failing a goal.

1. Definitions

  • Source commitment — the failed commitment for which a waiver was activated.
  • Referring user — the user who owns the source commitment and activates the waiver.
  • Referred user — the person who follows the waiver link and creates their own Commitery account.
  • Qualifying checkout — a checkout by a referred user meeting the conditions in section 4.

2. Activating a waiver

A waiver can be activated by the user who owns a commitment that has been marked as failed and for which a conditional charge is still pending. Activation is possible only while the option is shown in the product for that commitment, and only once per failed commitment, including individual routine cycles. The waiver is tied to that single commitment and cannot be moved to another commitment, routine cycle, or account.

A waiver link proposes no commitment. The referred user decides for themselves what to commit to, on what terms, and for what amount.

3. Effect of activation

Activation postpones the conditional charge for the source commitment until the deadline displayed with the waiver. Postponement is not cancellation: if no qualifying checkout occurs before the deadline, the original charge becomes due and Commitery may collect it using the payment method on file, as described in the Payment Terms. The payment method must remain valid for the duration of the waiver period.

Activation does not change, reverse, or reopen the failed verdict, and does not extend, pause, or replace the product dispute window. Disputes remain governed by the Terms of Use.

4. What qualifies

A referral qualifies only if all of the following are true before the displayed deadline:

  • a person who is genuinely new to Commitery follows the waiver link issued for the source commitment and creates their own account after the waiver was activated;
  • that person completes checkout of their own first financial commitment with a commitment amount of at least the minimum shown in the product; and
  • the checkout is completed and not cancelled before it is concluded.

Sharing the link, clicking the link, signing up without checking out, or checking out after the deadline does not qualify. One qualifying referral is sufficient, and further referrals for the same commitment have no additional effect.

5. What does not qualify

Self-referrals, referrals to accounts controlled by the referring user, duplicate or re-registered accounts, coordinated or reciprocal referral rings, automated sign-ups, and any checkout that Commitery reasonably considers manipulated do not qualify. Commitery may verify eligibility before granting a waiver and may refuse a waiver where these conditions are not met.

6. Result of a qualifying referral

If a referral qualifies, Commitery waives the entire conditional charge for the source commitment. No amount is charged for that failure and no credit, refund, or balance arises from the waiver. If the charge had already been collected before the qualifying checkout was recognised, Commitery may instead refund the collected amount to the original payment method.

The waiver is final once granted. If the referred user later withdraws from, cancels, or is refunded for the commitment that triggered the waiver, the waived charge is not reinstated. This does not apply where the referral did not qualify in the first place under section 5.

7. If the deadline passes

If no qualifying checkout occurs before the deadline, the waiver is closed, the postponement ends, and the original conditional charge becomes due. Commitery will normally notify the referring user before collecting. The waiver cannot be reactivated for the same commitment.

8. Position of the referred user

A referred user enters into their own agreement with Commitery on the terms shown to them before checkout. Following a waiver link changes nothing about their commitment amount, deadline, proof requirements, or conditional charge, and creates no obligation towards the referring user. A referred user may be charged if their own commitment fails, in accordance with the Payment Terms, and is not shown the referring user's failed commitment.

9. No cash value, single level

A waiver has no cash value, cannot be paid out, saved, transferred, sold, or combined with another waiver, and never exceeds the conditional charge of the source commitment.

The waiver operates on a single level. A referring user's waiver depends solely on one qualifying checkout by the person they referred. No benefit of any kind arises from anything that person, or any further person, does afterwards. Commitery operates no tiers, downlines, recruitment targets, or rewards that increase with the number of people referred, and no user obtains any advantage from referrals made by users they referred.

10. Notifications

Commitery may send transactional messages about an activated waiver, including activation, a reminder before the deadline, and the outcome. These are service messages relating to a pending charge and are not marketing.

11. Data protection

To operate a waiver, Commitery records the link issued, its deadline, and whether a qualifying checkout took place, and connects the referring and referred accounts for that purpose. The referring user is not shown the identity of the person who signed up. Further information is set out in the Privacy Policy.

12. Changes and availability

The waiver may be modified, limited, or discontinued for future commitments at any time, and may be unavailable in some countries. Waivers already activated continue under the terms displayed at activation. Mandatory consumer rights, including withdrawal rights and the right to dispute a charge, remain unaffected.
