Referral and Challenge Terms

These Terms govern how Commitery users invite other people to Commitery and how they share challenges: commitments they have created and propose that others take on. They apply in addition to the Terms of Use, the Payment Terms, the Withdrawal Policy, and the Privacy Policy.

1. Scope

  • Invitation links. A link that invites another person to Commitery without proposing any particular commitment.
  • Challenge links. A link that proposes a specific commitment — its wording, amount, proof requirement, and rhythm — which another person may take on for themselves.

Remuneration under the Commitery Creator programme, Creator challenge links, payout eligibility, risk holds, and payout documents are governed by the Commitery Creator Terms. The option to avoid a conditional charge after a failed commitment by referring one new user is governed by the Referral Waiver Terms. Section 5 of these Terms applies to sharing under all of those documents.

2. Definitions

  • Sharing user — the user who creates or shares an invitation or challenge link.
  • Joining user — the person who follows that link and creates their own commitment.
  • Challenge — a proposed commitment attached to a link. A challenge is a proposal, not a contract.

3. Creating a challenge

A challenge is created from a commitment the sharing user has drafted or holds. It records the commitment wording, the proposed amount, the proof requirement, and, for routines, the rhythm. Creating a challenge does not create any commitment for anyone else and imposes no obligation on any person who sees it.

A sharing user may deactivate a challenge link at any time. Deactivation stops further joins and has no effect on commitments already entered into by people who joined earlier.

4. Position of the joining user

A challenge is shown to the joining user as a proposal, together with the full commitment terms they would agree to. Before accepting, the joining user reviews those terms and may change the amount and the timing for their own commitment. Nothing is agreed until they accept the terms and complete checkout.

The resulting commitment is an agreement between the joining user and Commitery on the terms the joining user accepted. The sharing user is not a party to it, cannot vary it afterwards, is not liable for it, and has no claim arising from it. A joining user may be charged if their own commitment fails, in accordance with the Payment Terms, and holds the withdrawal and dispute rights described in those documents.

A sharing user has no access to the joining user's account, commitments, proof, or personal data, and cannot act on their behalf.

5. Rules for sharing

Links are shared by the user, from their own accounts and applications. Commitery does not send invitations on a user's behalf and does not process the contact details of the people a user invites.

Users may not:

  • send links through unsolicited email, messages, or any other channel without the recipient's consent;
  • make claims about Commitery that are inaccurate or misleading, in particular about whether the person joining can be charged;
  • present themselves as Commitery, as acting on behalf of Commitery, or as authorised to vary any commitment terms;
  • pressure another person into taking on a commitment, or propose a challenge to a person who cannot validly enter into one;
  • advertise on Commitery brand terms, or distribute links through spam, automated posting, coupon or cashback aggregators, or in breach of the rules of the platform they are posting on.

This section applies to every link issued in the product, including Creator links and referral waiver links.

6. Remuneration and disclosure

Sharing an invitation or challenge link does not by itself entitle a user to remuneration. A user who takes part in the Commitery Creator programme may receive remuneration for commitments attributed to their links, and a user who has completed payout setup may receive remuneration through links they share generally.

A user who receives or may receive remuneration must disclose that fact clearly wherever they promote Commitery, before the person they are addressing acts on the link. Guidance is set out in the Creator disclosure documentation.

7. Public challenge pages

A challenge link may be served as a public page showing the sharing user's handle, the challenge title, the proposed terms, and any details the sharing user adds. A sharing user must not include personal data of other people, confidential information, or content they are not entitled to publish. Commitery may remove a challenge page that breaches these Terms or the Terms of Use.

8. Data protection

To operate a link, Commitery records the link, its status, and whether a commitment was created through it, and connects the sharing and joining accounts for that purpose. A sharing user is not shown the identity of a person who joined unless that person makes it visible themselves. Further information is set out in the Privacy Policy.

9. Misuse

Commitery may deactivate a link, disable link sharing for a user, remove a challenge page, or take further measures under the Terms of Use where a user breaches these Terms or uses links to harm other users or third parties.

10. Changes and availability

Link and challenge features may be modified, limited, or discontinued at any time, and may be unavailable in some countries. Commitments already entered into are unaffected. Mandatory consumer rights remain unaffected.
